Terms of Service for EditTextImage

These Terms of Service ("Terms") govern your access to and use of edittextimage.online and the EditTextImage image text editing service (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

EditTextImage allows users to upload an image, identify existing text, provide replacement text, and request an AI-generated edited image that aims to preserve the original layout, style, and aspect ratio. Features may include accounts, generation history, downloads, credits, paid plans, and other image tools.

AI editing is probabilistic. We do not guarantee that text will be recognized or replaced correctly, that all visual details will remain unchanged, or that an output will be suitable for your intended use.

We may add, modify, limit, suspend, or discontinue features. We may also impose technical limits to protect reliability, security, and fair use.

2. Eligibility and Accounts

You must be at least 13 years old, or the higher minimum age required in your jurisdiction, and legally able to enter into these Terms. If you use the Service for an organization, you represent that you have authority to bind that organization.

You agree to provide accurate account and billing information, keep your login method secure, and accept responsibility for activity under your account. You must promptly notify us at support@edittextimage.online if you suspect unauthorized access.

You may not sell, transfer, share, or misuse an account in a way that bypasses access, payment, safety, or credit controls.

3. Credits, Plans, and Payments

Some features require credits or a paid plan. Prices, credit amounts, renewal terms, validity periods, and plan limitations shown at checkout form part of these Terms.

• You authorize us and our payment provider to charge the amount displayed at checkout.
• Payment card details are handled by the payment provider and are not stored directly by EditTextImage.
• Credits have no cash value, cannot be transferred, and may expire according to the plan or purchase terms shown when issued.
• Eligible failed generation jobs may result in restoration of held credits according to our system records.
• Except where required by law or expressly stated at checkout, completed purchases are non-refundable.
• We may change future prices, plans, and credit rules, but changes will not retroactively alter a completed one-time purchase.

Taxes, currency conversion charges, and payment-provider fees may apply depending on your location and payment method.

4. Your Content

"Your Content" includes uploaded images, original and replacement text, prompts, instructions, reference materials, and other content you submit.

You retain your rights in Your Content. You grant EditTextImage and its service providers a worldwide, non-exclusive, limited license to host, copy, transmit, modify, process, and display Your Content only as reasonably necessary to provide, secure, troubleshoot, and improve the Service, enforce these Terms, and comply with law.

You represent and warrant that:

• you own Your Content or have all necessary permissions to upload and edit it;
• your instructions and intended use do not violate law, contract, privacy, publicity, intellectual property, or other third-party rights; and
• you have obtained any consent required for images depicting identifiable people or private property.

5. Generated Outputs

"Output" means an image or other result produced by the Service. As between you and EditTextImage, and to the extent permitted by law, we do not claim ownership of your Output. Your ability to obtain or enforce intellectual property rights in AI-generated material may vary by jurisdiction.

Outputs may be inaccurate, incomplete, unexpected, or similar to outputs created for others. You are responsible for reviewing every Output before publishing or relying on it, including text accuracy, visual consistency, authenticity, legality, and third-party rights.

You may use Outputs for lawful personal or commercial purposes, subject to these Terms, applicable law, third-party rights, and any restrictions disclosed for the applicable model or plan. We do not provide legal clearance or guarantee non-infringement.

6. Prohibited Uses

You may not use the Service to create, alter, upload, or distribute content that:

• violates law or infringes intellectual property, privacy, publicity, contractual, or other rights;
• fraudulently changes government identification, passports, visas, licenses, certificates, academic records, medical records, legal documents, financial statements, invoices, receipts, transaction records, tickets, or proof of payment;
• impersonates another person or falsely represents approval, sponsorship, authorship, affiliation, evidence, or authenticity;
• facilitates fraud, phishing, scams, identity theft, forgery, misinformation, or deceptive commercial practices;
• contains child sexual abuse material, sexual exploitation, non-consensual intimate imagery, or sexual content involving minors;
• promotes violence, abuse, harassment, hateful conduct, or illegal activity;
• violates another person's consent or uses their likeness deceptively;
• contains malware or attempts to extract credentials, private data, or confidential information; or
• is otherwise harmful or reasonably likely to cause legal, financial, reputational, or physical injury.

You also may not:

• bypass safety filters, rate limits, access restrictions, payment systems, or credit accounting;
• probe, attack, disrupt, overload, scrape, reverse engineer, or introduce malicious code into the Service;
• use automated access except through an interface or API expressly authorized by us;
• resell, sublicense, or provide the Service as your own without written permission; or
• use the Service or its Outputs to train or develop a competing model or service where prohibited by law or without our written permission.

We may reject requests, remove access to content, suspend or terminate accounts, preserve evidence, or report conduct when we reasonably believe these Terms have been violated.

7. Intellectual Property

The Service, including its software, interface, design, branding, logo, documentation, and underlying systems, is owned by EditTextImage or its licensors and is protected by applicable laws. These Terms do not grant you ownership of the Service.

You may not copy, modify, distribute, sell, lease, or reverse engineer any part of the Service except as permitted by law or with our written authorization.

If you send feedback, you grant us a perpetual, worldwide, royalty-free right to use it without restriction or compensation, provided we do not publicly identify you without permission.

8. Third-Party Services

The Service relies on third parties for AI processing, authentication, hosting, database, storage, analytics, and payments. Their availability, terms, and policies may affect the Service. We are not responsible for third-party services outside our reasonable control.

Your use of Google sign-in, Stripe checkout, or other third-party features may also be governed by that provider's terms and privacy policy.

9. Privacy

Our Privacy Policy explains how we collect, use, store, and disclose information, including uploaded images and AI processing data. By using the Service, you acknowledge those practices.

10. Suspension and Termination

You may stop using the Service at any time. You may request account or personal-data assistance by contacting us.

We may suspend or terminate access, restrict features, or remove content if you violate these Terms, fail to pay, create security or legal risk, abuse the Service, or if continued operation is no longer commercially or technically feasible.

Termination does not automatically create a right to a refund. Provisions that by their nature should survive will remain effective, including payment obligations, licenses necessary for prior processing, intellectual property, disclaimers, limitations of liability, indemnity, and dispute provisions.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." EditTextImage disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

We do not warrant uninterrupted or error-free operation, permanent storage of images, successful text replacement, preservation of every visual detail, or that Outputs will meet your requirements. You should retain independent copies of important files.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

12. Limitation of Liability

To the fullest extent permitted by law, EditTextImage and its operators, affiliates, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, goodwill, business opportunities, or reputation arising from the Service or Outputs.

To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid to EditTextImage during the three months before the event giving rise to the claim or (b) USD $50.

These limitations do not apply where liability cannot be limited or excluded under applicable law.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless EditTextImage and its operators, affiliates, suppliers, and service providers from claims, damages, liabilities, losses, and reasonable expenses arising from Your Content, your Outputs or their use, your violation of these Terms, or your infringement of another person's rights.

This section does not apply to the extent prohibited by mandatory consumer law.

14. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which the operator of EditTextImage is established, without regard to conflict-of-law rules. Courts with jurisdiction over that operator will have exclusive jurisdiction, except where mandatory consumer law gives you the right to bring a claim elsewhere.

Before filing a formal claim, you agree to contact support@edittextimage.online and attempt to resolve the dispute informally for at least 30 days. This does not prevent either party from seeking urgent injunctive relief or using a small-claims procedure where available.

15. Changes to These Terms

We may update these Terms to reflect changes to the Service, providers, pricing, or law. We will post the revised Terms here and update the effective date. If a change is material, we may provide additional notice. Changes apply prospectively unless law requires otherwise.

16. General Terms

If any provision is unenforceable, it will be modified only to the extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, or sale. These Terms and incorporated policies form the entire agreement concerning the Service.
